These Terms of Service ("Terms") govern your use of the Halo Hospitality, LLC websites at https://www.halo-hospitality.com and our booking site at https://halohospitality.holidayfuture.com (together, the "Site") and any bookings, reservations, or property management services provided by Halo Hospitality, LLC ("Halo Hospitality," "we," "us," or "our"), a Tennessee limited liability company operating in the Knoxville, Tennessee area. By accessing our Site or using our services, you agree to these Terms. If you do not agree, please do not use our Site or services.

1. Acceptance of Terms

By accessing or using our Site, making a booking, or engaging our property management services, you confirm that you are at least 18 years of age, have the legal capacity to enter into binding agreements, and agree to be bound by these Terms and our Privacy Policy. If you are booking on behalf of a group, you accept these Terms on behalf of all guests and are responsible for ensuring all guests comply.

2. Bookings and Reservations

Direct bookings through our Site are processed via our booking platform. By submitting a booking, you agree to:

  • Provide accurate and complete guest information, including a valid government-issued ID upon request.

  • Be the primary guest responsible for the booking and all guests staying at the property.

  • Pay all charges in full at the time of booking, including the nightly rate, applicable taxes, cleaning fees, and any other fees disclosed at checkout.

  • Review and accept any property-specific house rules displayed during the booking process.

A booking is not confirmed until you receive a written confirmation from us or through our booking platform. We reserve the right to decline or cancel a booking at our discretion, in which case a full refund will be issued.

3. Check-In and Check-Out

Standard check-in and check-out times apply to all properties unless otherwise stated in your booking confirmation:

  • Check-in: 4:00 PM or as specified in your arrival instructions.

  • Check-out: 10:00 AM or as specified in your departure instructions.

Early check-in and late check-out may be available upon request and are subject to availability and additional fees. Guests who fail to check out by the designated time may be charged a late departure fee equal to one additional night's rate.

4. Cancellation and Refund Policy

Cancellation policies vary by property and are clearly displayed before you complete your booking. The cancellation policy applicable to your specific reservation governs your eligibility for a refund. In general:

  • Cancellations made within the policy's free-cancellation window are eligible for a full refund.

  • Cancellations made outside that window may forfeit the full booking amount.

  • No-shows and early departures are non-refundable.

  • Cleaning fees are non-refundable once the stay has begun.

Refunds, where applicable, are returned to the original payment method and may take 5–10 business days to process. We are not liable for delays caused by your bank or card issuer.

5. Guest Responsibilities and House Rules

As a guest, you agree to respect the property and the surrounding community. During your stay:

  • Do not exceed the maximum occupancy stated in your booking. Unauthorized guests are not permitted.

  • No smoking (including vaping and cannabis) inside any property. Outdoor smoking must be in designated areas, if any. A minimum cleaning fee of $300 applies for violations.

  • No pets unless explicitly permitted in the property listing. Unauthorized pets will result in a minimum $200 fee.

  • Comply with quiet hours (10:00 PM – 8:00 AM) and all applicable City of Knoxville noise ordinances.

  • No parties, events, or gatherings beyond the authorized number of guests.

  • Follow all posted parking restrictions. Vehicles parked in violation may be towed at the guest's expense.

  • Do not rearrange or remove furniture, fixtures, or appliances from the property.

  • Dispose of trash in designated receptacles; leave the property in the condition in which it was found.

  • Report any maintenance issues, damage, or safety concerns to us immediately.

We reserve the right to terminate a stay without refund and pursue additional remedies if house rules or these Terms are violated.

6. Damage and Security Deposits

Guests are responsible for any damage to the property, furnishings, appliances, or surrounding areas caused during their stay, whether by themselves or other guests they authorize. A security deposit or damage hold may be required at booking or check-in, as specified in your confirmation. If damages exceed the deposit amount, you authorize us to charge the difference to the payment method on file. We will provide an itemized damage assessment within 7 days of check-out if charges apply.

We recommend obtaining travel insurance to protect against accidental damage, unexpected cancellations, and other unforeseen expenses.

7. Pricing and Payment

All prices are listed in U.S. dollars (USD) and include applicable state and local taxes unless otherwise noted. Tennessee state and local sales tax and any applicable Knoxville and Knox County occupancy (hotel/motel) taxes are included in or added to the displayed rate. We reserve the right to adjust pricing at any time; however, confirmed bookings will not be affected by subsequent price changes. Promotional rates and discounts cannot be applied retroactively.

8. Property Descriptions and Accuracy

We make every effort to provide accurate, up-to-date descriptions, photos, and amenity information for each property. Minor variations between photos and actual conditions (such as updated furnishings or seasonal décor) do not constitute a misrepresentation. If you arrive and find a significant discrepancy — such as a missing essential amenity listed in your booking — please contact us immediately. We will work to remedy the issue or, if necessary, relocate you to a comparable property. Complaints raised after check-out may not be eligible for compensation.

9. Property Management Services

For property owners who engage Halo Hospitality to manage their properties, a separate Property Management Agreement governs the specific terms of that relationship, including management fees, owner distributions, maintenance responsibilities, and listing authority. These Terms of Service apply to owners using our website and inquiry tools. If you are a property owner interested in our management services, please contact us to receive a Management Agreement before services begin.

10. Limitation of Liability

To the fullest extent permitted by Tennessee law, Halo Hospitality, LLC is not liable for any indirect, incidental, special, or consequential damages arising from your use of our Site or services, including but not limited to loss of enjoyment, personal injury, theft, or property loss during a stay. Our total liability for any claim related to a booking shall not exceed the total amount you paid for that specific booking. We are not responsible for disruptions caused by events outside our control, including utility outages, force majeure events, or acts of third parties.

11. Text Messaging

By providing your phone number and opting in to text messages from Halo Hospitality, LLC, you agree to receive text messages about your inquiry, reservation, booking confirmations, check-in instructions, access details, stay updates, and guest support. Message frequency varies based on your inquiry or booking activity. Message and data rates may apply. Carriers are not liable for delayed or undelivered messages. 12. Website Use, Intellectual Property, and License

All content on this Site — including text, photographs, graphics, logos, and software — is owned by or licensed to Halo Hospitality, LLC and is protected by copyright and other intellectual property laws. You may access this content for your own personal, non-commercial use, subject to these Terms. You may not:

  • Republish, redistribute, or publicly display material from this Site;

  • Sell, rent, or sub-license material from this Site;

  • Reproduce, duplicate, or copy material from this Site; or

  • Create derivative works from any content on this Site,

in each case without our express written permission. No use of the Halo Hospitality name or logo for linking or any other purpose is permitted without a written license agreement.

13. User-Submitted Content

Certain areas of the Site allow guests and visitors to post comments, reviews, or other content. We do not pre-screen all such content and are not responsible for content posted by users; comments reflect the views of the person who posts them, not those of Halo Hospitality, LLC. By posting content, you represent and warrant that:

  • You are entitled to post the content and hold all necessary rights and consents to do so;

  • The content does not infringe any intellectual property right, including copyright or trademark, of any third party;

  • The content does not contain defamatory, libelous, offensive, indecent, or otherwise unlawful material, or material that invades another person's privacy; and

  • The content will not be used to solicit or promote business or unlawful activity.

You grant Halo Hospitality, LLC a non-exclusive, royalty-free license to use, reproduce, edit, and authorize others to use, reproduce, and edit any content you post, in any form or media. We reserve the right to monitor all content and to remove, at our sole discretion, any content we consider inappropriate, offensive, or in breach of these Terms.

14. Disclaimer of Warranties

The Site and the information and services provided on it are made available on an "as is" and "as available" basis. To the maximum extent permitted by applicable law, we exclude all representations, warranties, and conditions relating to the Site and its use. We do not warrant that the information on the Site is correct, complete, or accurate, that the Site will remain available, or that the material on it is kept up to date.

Nothing in these Terms or this disclaimer will limit or exclude our or your liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any liability that may not be limited or excluded under applicable law.

15. Modifications to Terms

We reserve the right to modify these Terms at any time. Updated Terms will be posted on this page with a revised "Last Updated" date. Material changes will be communicated via email to guests with active bookings. Your continued use of our Site or services after changes are posted constitutes acceptance of the revised Terms.

16. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Tennessee, without regard to its conflict-of-law provisions. Any dispute arising from these Terms or your use of our services shall be brought exclusively in the state or federal courts located in Knox County, Tennessee, and you consent to personal jurisdiction in those courts.
